Web Designly Ltd (“we”, “us”, “our”) is the data controller responsible for the personal information described in this policy. We are a company registered in England and Wales under company number 13212666. This policy sets out how we collect, use and protect personal information obtained through webdesignly.com (the “site”), and explains the rights available to you under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

1. Information we collect

1.1 Information you provide through the contact form. The contact form on this site submits the information you enter to our own server, which forwards it to us by email. The information transmitted comprises your name, your email address, and — where you choose to provide them — your organisation, the categories of work you are enquiring about, an indicative budget range and the contents of your message. We do not retain a copy of that submission in any database; the email in our inbox is the only record created.

1.2 Information you provide by email. Where you write to us directly, we receive your email address, any name associated with it and the contents of your correspondence.

1.3 Technical information. Our hosting provider processes limited connection data, including IP address, user agent and request time, in server logs. This processing is carried out for the security, availability and integrity of the site. We do not use this information to identify individual visitors or to construct a profile of them.

1.4 Information we do not collect. The site operates no analytics package, sets no advertising or measurement cookies, and embeds no third-party tracking scripts.

2. Purposes and lawful bases for processing

We process personal information for the following purposes and on the following lawful bases:

• To respond to your enquiry and to prepare a proposal or quotation. Our lawful basis is our legitimate interests in responding to persons who contact us, and, where a proposal is requested, the taking of steps at your request prior to entering into a contract.
• To perform a contract for services. Where we are engaged to carry out work, we process contact and project information as necessary for the performance of that contract.
• To maintain the security and availability of the site. Our lawful basis is our legitimate interests in protecting our systems from misuse.
• To comply with legal obligations, including the retention of accounting and tax records.

3. Disclosure of information

We do not sell personal information, and we do not disclose it to third parties for their own marketing purposes.

We disclose personal information to service providers who process it on our behalf and under our instructions, namely our hosting and email providers. Such providers are permitted to process the information only to the extent necessary to supply the relevant service to us.

We may disclose personal information where we are required to do so by law, by a court of competent jurisdiction, or by a regulatory authority, or where disclosure is necessary to establish, exercise or defend legal claims.

4. International transfers

Our hosting and email providers may process information on infrastructure located outside the United Kingdom. Where information is transferred outside the UK, that transfer is made subject to appropriate safeguards recognised under the UK GDPR, including adequacy regulations or the International Data Transfer Agreement.

5. Retention

We retain enquiry correspondence for so long as is necessary to respond and to conclude any resulting discussion. Where an engagement proceeds, we retain project correspondence and records for the duration of the engagement and for a further period of six years, in order to comply with statutory limitation periods and with our obligations under the Companies Act 2006 and applicable tax legislation. Server logs are retained for a short period determined by our hosting provider and are then deleted or aggregated.

You may request the deletion of correspondence at any time, subject to the retention obligations described above.

6. Your rights

Subject to the conditions and exemptions set out in the applicable legislation, you have the right to request access to the personal information we hold about you; to request its rectification or erasure; to request the restriction of processing; to object to processing carried out on the basis of our legitimate interests; and to request the portability of information you have provided to us.

Requests should be made to legal@webdesignly.com. We will respond within one month of receipt, and we will not charge a fee save where a request is manifestly unfounded or excessive.

You also have the right to lodge a complaint with the Information Commissioner’s Office, the supervisory authority for data protection in the United Kingdom, at ico.org.uk. We would ask that you raise the matter with us first so that we may attempt to resolve it.

7. Cookies

The site does not set cookies for analytics, advertising or profiling purposes, and accordingly displays no consent banner. Should this position change, we will amend this policy and, where the Privacy and Electronic Communications Regulations 2003 require it, obtain your consent before any such cookie is set.

8. Security

We maintain technical and organisational measures appropriate to the limited nature of the information we hold, including encryption of the site in transit and restricted access to the mailbox in which enquiries are received. No method of transmission over the internet is entirely secure, and we cannot guarantee the security of information transmitted to us.

9. Amendments

We may amend this policy from time to time. The date shown above indicates when it was last revised. Where an amendment is material, we will take reasonable steps to bring it to the attention of those affected.
